The owner of the Online Shop Ukupaca.com (referred to as the Online Shop) is Ukupaca OÜ (registry code 16618104).
 

Validity of the sales contract, product and price information

The terms of sale apply to the purchase of goods from the Online Shop.

The prices of the products sold in the Online Shop are indicated next to the products. The price includes a fee for delivering the goods.

The fee for delivering the goods depends on the location of the customer and the method of delivery. 

The delivery fee is displayed to the customer when completing the order.

Information about the product is provided in the Online Shop directly next to the product.

 

Forming the order

To form the order, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid via a bank link or other payment solution.

The contract is accepted when the receipt of the amount is paid to the current account of the Online Shop.

If the ordered goods cannot be delivered due to lack of the goods or for some other reason,
the customer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.

 

Delivery

The sales take place in Europe.

Delivery methods: courier, parcel machine, self-pickup.

Delivery partners are Itella SmartPost.

The shipping costs are borne by the customer, and the corresponding price information is displayed next to the shipping method.

Shipments generally arrive at the destination specified by the customer within 3-7 working days from
the entry into force of the sales contract. Outside Estonia, delivery takes place within a calendar day.

In exceptional cases, you have the right to deliver the goods within 45 calendar days.

 

Right of withdrawal

After receiving the order, the customer has the right to withdraw from the contract concluded in the Online Shop within 14 days [depending on the products, the customer may not have the right of withdrawal, in such a case the corresponding products and services must be listed and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act].

The right of withdrawal does not apply if the customer is a legal entity.

In order to use the 14-day right of return, the ordered goods must not be used in any other way than is necessary to make sure of the nature, characteristics and functioning of the goods in a way that is allowed for testing the goods in a physical shop.

If the goods have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Shop has the right to reduce the refundable fee according to the decrease in the value of the goods.

In order to return the goods, you must submit an application for withdrawal from the purchase of the goods, the form of which can be found here:
Application for withdrawal, and send it to the e-mail address within 14 days of receiving the goods at the latest.

The cost of returning the goods is borne by the customer, unless the reason for the return is that
the item to be returned does not correspond to what was ordered (e.g. a wrong or defective item).

The customer must return the goods within 14 days after submitting the application or provide proof that he
has handed over the goods to the carrier of the goods within the aforementioned period.

Upon receiving the returned goods, the Online Shop will return to the customer immediately, but no later than 14 days after receiving the withdrawal, all fees received from the customer under the contract.

The Online Shop may refuse to issue refunds until it has received the item that is the subject of the contract or until the customer has provided evidence that it has returned the item, whichever occurs first.

If the customer has explicitly chosen a delivery method other than the cheapest usual delivery method offered by the Online Shop , the Online Shop does not have to refund the cost to the consumer that exceeds the cost associated with the usual delivery method.

The Online Shop has the right to withdraw from the sales transaction and demand the return of the goods from the customer if the price of the goods in the Online Shop is marked significantly below the market price of the goods due to an error.

 

The right to file a claim

The Online Shop is responsible for the non-compliance of the goods sold to the customer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the customer. Within the first six months from the delivery of the item to the customer, it is assumed that the defect was already present at the time of delivery of the item. It is the Online Shop’s responsibility to refute the corresponding assumption.

If a defect appears, the customer has the right to contact the Online Shop within two months at the latest by sending an e-mail to the address info@ukupaca.com or by calling +372 5503 716.

The Online Shop is not responsible for defects that have occurred after the goods have been handed over to the customer.

If the goods purchased from the Online Shop have defects for which the Online Shop is responsible,
the Online Shop will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Shop will return all fees associated with the sales contract to the customer.

The Online Shop responds to the consumer’s complaint in writing or in a format that can be reproduced in writing 15 days.

 

Direct marketing and personal data processing

The Online Shop uses the personal data entered by the customer (including name, phone number, address, e-mail address, bank details) only to process the order and send the goods to the customer. The Online Shop transmits personal data to companies providing transport services in order to deliver the goods.

The Online Shop sends the customer newsletters and offers to the customer’s e-mail address only if the customer has expressed his wish to do so by entering an e-mail address on the website and has indicated their wish to receive direct e-mail notifications.

The customer can opt out of offers and newsletters sent to e-mail at any time by
notifying us by e-mail or by following the instructions in the e-mail containing the offers.

 

Solving arguments

If the customer has complaints about the Online Shop, they should send an e-mail to info@ukupaca.com or call +372 5503 716.

If the customer and the Online Shop cannot resolve the dispute by agreement, the customer can appeal
to the Consumer Disputes Committee. The customer can familiarize themselves with the procedural conditions and submit an application.
The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the customer and the Online Shop. Review of the customer’s complaint by the commission is free of charge. The customer can turn to the platform for resolving consumer disputes of the European Union.
